The company waited for a moving target
Dan’s testimony describes several associated vessels waiting near the entrance to the Red Sea for a fleet from Mocha. He says it passed them unseen and that another vessel supplied the information that prompted pursuit. [1]
The opportunity therefore depended on intelligence and timing. Waiting at a likely route did not guarantee that a fleet would be seen as it passed.
A smaller capture preceded the larger one
The witness describes first taking another vessel, removing gold and silver and placing men aboard to keep it with the company. He then places the encounter with the much larger Gunsway later in the sequence. [1]
Keeping these captures separate avoids creating one composite battle with every detail attached to the same hull.
The testimony follows the taking and aftermath
Dan says the company fought the larger ship, boarded it, placed men aboard and plundered it before sending the vessel onward toward Surat with its people. He describes the money being shared afterward on the Indian coast. [1]
That sequence is the witness’s account. A precise-looking battle duration or treasure total should remain attributed rather than presented as a modern audited measurement.
The victims were part of an existing maritime world
The indictment and opening address identify Mughal ownership and subjects. The English court’s vocabulary is a historical source, not the full range of names and perspectives through which the voyage can be understood. [1]
The capture belongs to Indian Ocean commerce and mobility as well as to the history of European pirates. The company interrupted someone else’s voyage rather than finding wealth outside society.
The prosecution connected robbery to diplomacy
Newton argued that attacks could disturb commerce and friendship between nations and draw wider consequences. This was a prosecution’s appeal to the jury, not an impartial summary of every government’s later actions. It nevertheless shows the scale on which authorities wanted the case understood. [1]
Continue with the acquittal and subsequent proceedings, the pursuit and the absent captain. A raid and the judicial response to it are connected events with different evidence.
Questions, answered.
Does this page treat every statement in the prosecution speech as a proven fact?
No. The speech is identified as advocacy, while witness descriptions remain attributed.
Was Gunsway the only capture in the voyage account?
No. The testimony distinguishes earlier captures and another vessel taken before the larger ship.

Source checks distinguish an artifact, a reported account and a modern interpretation. They do not constitute independent historian review.

Opening Gunsway indictment and Newton’s address; Dan’s account of the fleet, smaller capture, Gunsway and distribution; the later summary of the voyage. Modern place-name and exact-date identifications require separate corroboration; period names are retained here. A proclamation states authorities’ information and demands; a trial print records allegations, witnesses and judgments. Neither makes every accusation an independently established fact. Named suspects are not automatically convicted defendants. TCP gaps and spelling variations remain.
