Capture was a provisional act of force
The commission permitted Kidd to apprehend ships and goods within its defined enemy categories. It did not say that everything seized immediately became his unquestioned property. It directed captured material to a convenient port for an authorized court. [1]
The difference placed a decision outside the captain’s own deck. The taking and the judgment were separate stages.
A court was to decide the prize
The text names the High Court of Admiralty or another lawfully authorized admiralty court. It then permits disposal of ships and goods that have been adjudged and condemned. The order of those actions is part of the grant, not a modern addition to it. [1]
Authority to attack an enemy and authority to decide every resulting property claim are not identical powers.
The journal created a trail
The same commission required an exact journal, with prizes, dates, places and estimated values recorded. It also called for information about enemy movements and intelligence obtained. Documentation was one of the captain’s assigned tasks. [1]
Such requirements explain why missing papers could matter greatly afterward. A commission belonged to a larger administrative process of reporting and review.
The French-pass argument did not remove the next stage
When Kidd argued that Quedagh Merchant had French protection, judges asked why he had not condemned it as a prize. In their argument, proving an enemy connection would still leave a procedural obligation. [1]
Whether a particular document existed, what it established and what should have happened afterward were three separate questions.
Commerce made the distinctions consequential
Witnesses described goods belonging to Armenian merchants and money divided after sales. The adjudication dispute therefore concerned identifiable commercial interests, not an abstract quarrel over a captain’s title. [1]
Compare the broader commission system, the captured merchant ship and pardons. Permission before an action, judgment about captured property and forgiveness for past offenses performed different work.
Questions, answered.
Could the captain’s own declaration replace the court’s judgment?
The commission reproduced here required an authorized admiralty adjudication before disposal.
Was a pardon the same as condemnation of a captured prize?
No. They addressed different matters: personal offenses and the status of captured property.
